1. Scope and trade accounts
These terms apply to orders placed with DPF-Professionals Ltd trading as M3CHS and use of our website. Our store supplies garages, workshops, fleet operators, mobile technicians and other business customers. By ordering for a business, you confirm that you are at least 18, have authority to act for that business, and are buying for business purposes. Business use and legitimate resale are permitted, subject to any product-specific licence restrictions. Provide accurate account, billing and delivery information and keep account access secure.
If a transaction is legally a consumer purchase, mandatory consumer rights apply notwithstanding the trade focus of this website. Nothing in these terms excludes rights or liabilities that cannot lawfully be excluded.
2. Products, compatibility and availability
Product descriptions and specifications form part of the information supplied before purchase. Images are illustrative and screen colours may differ, but this does not remove our obligations concerning description, quality or fitness for purpose. Check vehicle coverage, compatibility, software requirements, licence region, accessories and intended application before ordering. Contact us if you need advice; any specific purpose you want us to assess should be agreed with us before purchase.
Use equipment and chemicals in accordance with the manufacturer's instructions and safety information, including required training and protective equipment. Product-specific warranty, licence and subscription conditions will be stated where applicable. Some goods are dispatched directly by suppliers; catalogue availability and delivery estimates can change. We will tell you if we cannot fulfil your order.
3. Orders and acceptance
Placing an order is an offer to buy. An automated order receipt acknowledges your order and does not, on its own, confirm acceptance. Acceptance occurs when we expressly confirm it or dispatch the goods. Payment may be taken before acceptance. If we cannot accept or fulfil an order, we will contact you and refund sums paid for the unfulfilled items and any associated delivery charge as appropriate.
If we discover a material pricing or description error, we will explain it and ask whether you want to proceed on the corrected basis or cancel with a refund. We will not substitute a materially different product or increase an accepted price without your agreement. Contact us promptly for changes or cancellation; we will confirm what is possible before dispatch.
4. Prices, VAT and payment
Prices are in pounds sterling. Trade prices may be displayed excluding VAT where clearly labelled. Applicable VAT, delivery charges, discounts and the total payable are shown before you pay. VAT registration number: GB476928336. Unless we agree credit terms separately in writing, payment is due when ordering. You must be authorised to use the payment method provided.
Changes to future prices or promotions do not alter the agreed price of an accepted order. Offer-specific conditions are shown with the offer. Free-delivery eligibility is explained in our Delivery Policy.
5. Delivery, ownership and risk
Delivery arrangements, charges and lead times are set out in our Delivery Policy and the product or checkout information supplied before ordering. Estimates are not guarantees unless we expressly agree otherwise. Supplier dispatch may result in separate parcels. We remain your seller and point of contact.
Ownership passes when we have received full payment for the goods. Where we arrange delivery, risk of loss or damage remains with us until delivery to you or your nominated recipient. Please report missing or damaged goods promptly and retain packaging where possible. We will investigate delays and discuss appropriate options if we cannot supply as agreed.
6. Returns, faults and warranties
Our Returns and Refunds Policy forms part of these terms. It provides a voluntary 30-day unwanted-goods return offer for eligible unused goods and a separate process for faults, damage, incorrect goods and warranty claims. Business buyers do not have an automatic consumer cooling-off period. Our contractual offer and any mandatory rights remain applicable.
Manufacturer warranties vary by product. Software licences, updates and subscriptions may have activation and renewal conditions stated before purchase. A manufacturer's warranty does not remove our obligations as seller. Do not assume that an equipment purchase includes unlimited updates, subscriptions or compatibility beyond the coverage stated for that product.
7. Membership
Membership fees, billing frequency, benefits, any minimum term, renewal and cancellation arrangements must be provided before you agree to a paid membership. An enquiry or trade-account request does not by itself authorise recurring charges. Membership delivery benefits apply only to expressly qualifying products and services. Our advertised first-30-days membership fee refund offer is explained on the membership page and is separate from product returns.
8. Website use, intellectual property and third parties
You may use this website to research and purchase products for your business. Website materials, branding and other intellectual property belong to us or the relevant owners. You may not reproduce or commercially exploit them without permission, except as permitted by law. Do not use the site unlawfully, submit misleading information, interfere with security, upload malicious code or misuse another person's information.
Third-party links and optional tools may have their own terms. We do not control external websites, but referring you to a supplier, manufacturer or service centre does not remove our obligations for goods we sell. We may suspend website access for misuse; this does not extinguish valid rights relating to existing orders.
9. Shopify and personal information
Our store is hosted by Shopify. Your sales contract is with DPF-Professionals Ltd trading as M3CHS, not Shopify. Shopify provides the ecommerce platform and is not the seller of our goods. See our Privacy Policy for how personal information is handled by us, Shopify and relevant service providers.
10. Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, our obligation to have the right to sell the goods, or any liability that cannot lawfully be excluded or limited.
Subject to the above and only to the extent permitted by applicable law and any applicable reasonableness requirement, we exclude liability for indirect or consequential business losses. We do not give a blanket exclusion of all responsibility for defective goods, inaccurate descriptions or our own breach of contract. Your responsibilities include following product instructions, using suitably qualified personnel and taking reasonable steps to prevent avoidable loss. Any separate negotiated business terms must be expressly agreed in writing.
11. Changes and existing orders
We may update these terms for future orders. The version provided when your order is accepted applies to that order; later website changes do not retrospectively remove your agreed rights. If a provision is unenforceable, the remaining provisions continue where lawful. A delay in enforcing a right is not a waiver of it.
12. Governing law and complaints
These terms and business sales contracts are governed by the law of England and Wales. The courts of England and Wales have jurisdiction over business contract disputes. This does not override mandatory protections or jurisdiction rights applicable to a consumer transaction.
